Menendez on Border Patrol Report Release

NEWARK, NJ - U.S. Senator Robert Menendez issued the following statement after the US Custom Border Patrol (CBP) agency released a revised use of force policy handbook and the Police Executive Research Forum (PERF) study on CBP use of force policies. The PERF report reviewed 67 Border Patrol cases that resulted in 19 deaths, and found Border Patrol agents used deadly force against individuals who threw rocks and have blocked the path of vehicles to justify firing live rounds.

"The release of this report is an encouraging step towards improving transparency at Border Patrol. Agency openness provides the public trust and cooperation that our country's border protection relies upon."

"The PERF report unfortunately also confirms what we have known for far too long: We need significant improvements in policy uniformity, transparency, and accountability at CBP. And while I am pleased that Border Patrol has already updated many key aspects of their use of force policies, more work is needed to establish uniform and clear practices that put an end to preventable deaths at the border. I continue to encourage the Border Patrol to fully implement the critically needed recommendations within this comprehensive report, and I welcome Commissioner Kerlikowske's promise of a continuous review of use of force policies."

Senator Menendez has continuously questioned the use of force by border agents. At current Commissioner of Customs R. Gil Kerlikowske's confirmation hearing,Senator Menendez urged the release of the PERF report and the implementation of its recommendations.
